PRIVACY POLICY STATEMENT

INTRODUCTION

  1. Defence Savings and Credit Co-operative Society Limited (DESACCO) was registered under the Cooperative Society Act Cap 490 on 10 April 2019. The SACCO intends to uplift the members’ social and economic well-being. Members are drawn from Kenya Defence Forces Service personnel both serving and retired. DESACCO is committed to the members’ privacy and the security of their personal information. In this agreement “you” and “your” mean any member with an account at DESACCO. “We”, “us” and “our” mean DESACCO. “Service” means DESACCO services accessed via our systems such as mobile app, members’ portal, website among others.

PERSONAL INFORMATION

  1. Personal information includes any information that lets DESACCO identify you as a unique individual, such as your name, surname, your physical address, contact details and/or national identity card number/service number/passport.
  2. Special personal information includes details of your race or ethnic and social origin, gender, religious, philosophical and conscience, beliefs, political persuasion, property details, marital status, family details including details of children, parents, spouse or spouses, health status, genetic, biometric information, sex or sexual orientation or any criminal behavior which relates to alleged criminal offences or proceedings.
  3. DESACCO promises to treat all your personal information carefully and responsibly.

COLLECTION OF PERSONAL INFORMATION

  1. Personal information may be collected by DESACCO in writing as part of a written application form, email, telephone, online (https://defencesacco.com) or via the DESACCO Mobile Banking App.
  2. In most cases, personal information will be collected directly from you, but there may be other instances when DESACCO will collect personal information from other sources. The sources may include public records, places where you may already have made your personal information public, employer or credit bureaus. DESACCO will only collect your personal information from other sources where we are legally entitled or obliged to do so, and you can ask on which sources we used to collect your personal information.  

PURPOSE FOR COLLECTION OF PERSONAL INFORMATION

       7. The general purposes for which DESACCO collects and processes your personal information include, but are not limited to:     

  • Creating a record of you on our system to verify your identity, provide you with the products and/or services you have applied for and then communicate with and keep you informed about these products and/or services.
  • Assessing whether you qualify for credit, or an increase or decrease of your credit limit.
  • Identifying you and verifying your physical address.
  • Identifying your source of income and similar information.
  • Assessing your personal financial circumstances and needs before providing advice to you.
  • Any purpose related to the prevention of financial crime, including sanctions, screening, monitoring of anti-money laundering and any financing of terrorist activities.
  • Further processing for historical, statistical or research purposes where the outcomes will not be published in an identifiable format.
  • Providing income tax-related information to tax authorities.
  • Where you have been identified as a next of kin by a member, we create a record of you on our system.

PROCESSING OF INFORMATION

  1. Processing of personal information includes any initial processing that DESACCO does when we first collect your personal information. It also includes any further and ongoing processing that DESACCO is allowed to carry out legitimately in terms of the reasons listed in para 11 (below). The term ‘processing’ includes collecting, using, altering, merging, linking, organizing, disseminating, storing, retrieving, disclosing, erasing, archiving, destroying or disposing of personal information.
  2. DESACCO will only collect and process your personal information for the reason you provided it to us, or to enable us to comply with the requirements of specific laws and/or regulations that we are governed by.
  3. DESACCO may process your personal information to protect your or our legitimate interests. DESACCO will not collect and process personal information about you that we do not need.
  4. Furthermore, DESACCO will not process your special personal information unless:
  • You have consented to DESACCO processing it.
  • It is necessary to exercise or defend a right or obligation in law.
  • It is necessary to comply with a legal and/or regulatory obligation of public interest.
  • It is for certain historical, research or statistical purposes that would not adversely affect your privacy.
  • Your information has been made public.

PRODUCTS AND SERVICES

  1. For DESACCO to provide you with any product and/or service or onboard you as a member, there are some personal information fields that you have to fill. This information can be provided in writing, electronically or through telephone, but it must be accurate and complete. These fields are indicated by an asterisk (or as otherwise indicated) on the respective forms/websites. If DESACCO does not receive the necessary personal information, we will not be able to continue with your application. If you are already a member and DESACCO asks you for this information and you do not provide it, DESACCO will have to suspend the provision of the product and/or services for a period of time, or as the case may be, even terminate the service for you.

  INFORMATION SHARING

  1. For the purposes outlined in paragraph 11 (above), DESACCO will, in most instances, collect and process your personal information internally. However, there are times when DESACCO needs to outsource these functions to third parties, either within DESACCO or external to DESACCO. Where your personal information is shared internally within DESACCO, such sharing will be carried out only for the purposes outlined in paragraph 11 (above).
  2. DESACCO may also need to share your personal information with external organizations, such as credit bureaus, tax authorities or other regulatory or industry bodies, so that we can meet our due diligence or regulatory requirements. DESACCO will not share your personal information with third parties who do not need your personal information, or where DESACCO is not legally permitted to do so. When DESACCO decides to transfer your personal information to third parties, we will only provide it to organizations that have the same data privacy policies as DESACCO or those who are subject to laws relating to the processing of personal information that are similar to those that apply to DESACCO. 

YOUR RIGHTS

  1. To the extent that local legislation permits, you have the following rights regarding your personal information:
  • The right to access your personal information that we have on record.
  • The right to ask DESACCO to correct any of your personal information that is incorrect.
  • You can ask DESACCO to delete or destroy your personal information. DESACCO’s records are subject to regulatory retention periods, which means that DESACCO may not be able to delete or destroy your personal information immediately upon request.

  1. If you have a complaint relating to the protection of your personal information, including the way in which it has been collected or processed by DESACCO, please contact us using our contact details as listed below.

DESACCO RIGHTS

  1. DESACCO reserves the right to change this statement at any time. All changes to this statement will be posted on our website. The current version shall supersede and replace all previous versions of policy unless stated otherwise.

COMMUNICATION

  1. As a member, if you have not opted in to receiving electronic marketing communications via SMS, email or other media channels), DESACCO will not market to you using electronic media. If you have opted in to receiving marketing via electronic media, you have the right to opt out at any time by following the instructions on the marketing material received.
  2. As a non-member, if you would like to receive marketing information from DESACCO through electronic media, please submit your details to DESACCO in writing.
  3. We may contact you in person, by telephone, by email or using your address.
  4. You agree to inform us of any changes or additions to these details. You can contact us using our telephone number, email or the address as shown on our website contact page or as shown below.
